KADOKAWA Corporation and BOOK WALKER Co., Ltd. (hereinafter collectively “Company”) will hold the “Next Manga Awards” (hereinafter “Project”) on the official site and “Niconico Seiga (Manga),” “Niconico Manga” that are operated by the Company.
Those who wish to enter their works shall consent to these Terms and Conditions for Entry of Works for the “Next Manga Award” (hereinafter “Entry Terms”) before entering the Project. Those who have entered the Project are hereinafter referred to as Entrants.
1. Entry Method
In order to enter the Project on the website, it is necessary to log into an account issued and managed by the SNS and OS providers separately designated by the Company (hereinafter “External IDs”). Subject to the terms specified by the Company, Entrants shall submit a post after entering manga works that they think will be the next big hit, and the reasons for choosing that work and other input (such reasons and other input hereinafter “Content of the Post”) in the prescribed manner by the end of the period described on the official site and “Niconico Seiga (Manga),” “Niconico Manga” service pages. An entry shall be deemed to have been made at the time of submitting the post.
2. Handling of the Content of the Post
Entrants shall agree that the Company will use the Content of the Post in the magazines the Company publishes, or other publications, websites, etc., in any type of media. Entrants shall not exercise the moral rights of author in and to the Content of the Post against the Company.
The Company may use the Content of the Post for promotion, advertising or other purposes without the prior consent of Entrants, and make any modifications or alterations that may be needed when doing so.
3. Disclaimer
Entrants shall enter the Project at their own responsibility and cost.
The Project may be suspended or discontinued without any prior notification for the maintenance of “Niconico Seiga (Manga),” “Niconico Manga” system or other reason.
For all matters related to the use of External IDs, each Entrant shall comply with the terms of use established by the providers that issue and manage the relevant External IDs, and the Company shall assume no liability for External IDs, except where it is attributable to intentional or negligent conduct on the part of the Company.
The Company shall assume no liability to any Entrant for any damage, whether direct or indirect, caused by his/her entry to or inability to enter the Project. The Company shall be released from liability for any dispute arising out of an entry to the Project between the Entrant and any other third party.
4. Governing Law and Jurisdiction
If a dispute or other matter arises out of the Project or the Entry Terms, it shall be governed by the laws of Japan and the Tokyo District Court shall be the court that has exclusive jurisdiction in the first instance thereover. All descriptions of the Project and Entry Terms shall be provided in the Japanese language, and construed and interpreted only in the Japanese language.
5. The Company shall select and nominate works from among the works for which entries have been made. The following works shall not be accepted as entries for screening: works that contain excessively sexual or cruel content; works that infringe or are highly likely to infringe the copyrights or other rights or interests of a third party (including parodies and pastiches); works that defame or slander any specific individual or organization; works that contain content offensive to public order and morals; works that breach the Entry Terms; and works that are otherwise deemed inappropriate by the Company.
6. Any matters not prescribed in the Entry Terms shall be governed by the Terms of Use of “Niconico Seiga (Manga)” posted on the website and the Terms of Use of “Niconico Manga” Application posted on the application.
KADOKAWA Corporation and BOOK WALKER Co., Ltd. (hereinafter referred to as “Company”) will conduct voting for the Next Manga Awards (hereinafter referred to as ‟Project”) as stated on the prescribed page.
1. In order to participate in the Project, it is necessary to log into an account issued and managed by the SNS and OS providers separately designated by the Company (hereinafter “External IDs”). For the use of External IDs, each participant shall comply with the terms of use established by the providers that issue and manage the relevant External IDs, and the Company shall assume no liability for External IDs, except where it is attributable to intentional or negligent conduct on the part of the Company.
2. The voting results, information and comments provided as response to the Project (hereinafter referred to as “Comments, etc.”) may be used or published in magazines and on websites (including, but not limited to, Niconico; hereinafter referred to as “Media”) by the Company or any third party designated by the Company. Upon such use or publication, the Company may provide Comments, etc., to third parties that operate Media, other than the Company, to the extent necessary after ensuring that Comments, etc., do not contain any information from which individuals can be identified, and may also add postscript to, revise, make partial deletion of or otherwise modify the Comments, etc., without consent of the participants. Participants are required to acknowledge the above in advance prior to participation.
3. Any content that is offensive to public order and morals or harms the rights of any third party or otherwise falls under any prohibited matters prescribed in the Niconico Terms and Conditions shall not be accepted as entries to the Project.
4. Comments, etc., shall be numerically processed as statistical data that will not allow for recognition or identification of individuals and may be used by the Company or any third party designated by the Company in its future services (including, but not limited to, Niconico).
5. The Company shall treat any information, etc., acquired in connection with the Project in accordance with its Privacy Policy (https://group.kadokawa.co.jp/global/privacy_policy/main.html and https://www.bookwalker.co.jp/privacy_policy/global_main.html) and the Use of the Cookie Information (https://group.kadokawa.co.jp/global/privacy_policy/site_access.html and /en/siteaccess) and each participant shall agree thereto.
6. Please note that the Company cannot respond to any specific inquiries regarding the voting results or other matters related to the Project.
7. Any matters not prescribed in the Terms and Conditions for Voting shall be governed by the Terms of Use of “Niconico Seiga (Manga)” posted on the website and the Terms of Use of “Niconico Manga” Application posted on the application.
8. Please note that the Company shall assume no liability for any damage incurred by any participant arising from his/her participation or inability to participate in the Project.
